The company il Verde undertakes the overall procedure with the aim of submitting an objection against the posted forest maps, with an evaluation and assessment of the characteristics of the area of interest, in order to submit the objection electronically as well as sending the documentation to the official authorities, F.M.O.B. (Forest Map Objection Board) and representation in the respective Objection Review Committee (O.R.C.).
Our company which has extensive knowledge and experience in resolving objections as well as in forest legislation, provides the following services:
- Geographical location and property demarcation.
- Drafting a topographical diagram.
- Examination of supporting documents.
- Submission of an electronic objection and obvious error request.
- Creation of the physical objection and obvious error document and delivery it to the corresponding F.M.O.B. (Forest Map Objection Board).
- Photo Interpretation Technical Report writing.
- Technical Advisor Services to the Committees for the Examination of Objections on the posted forest maps (Objection Review Committee – O.R.C.) in support of the objection.
Forest maps were established by Law 2664/1998. Forest maps delineate and record forests, woodlands, grasslands and other forms of land. The compilation of the Forest maps is based on the aerial photographs of the year 1945 as well as recent aerial photographs.
The responsibility for the posting of Forest Maps as well as for all work up to and including the sanctioning of the forest map belongs to the respective Forest Directorate of the respective Decentralized Administration.
The Forest map is posted exclusively online on the EKXA S.A. website. following a relevant decision of the relevant Forestry Directorate.
Any interested party who has a legal interest can submit an objection against the content of the posted forest map.
For the areas where no objection will be raised, a sanction will be made immediately. The Forest map after its ratification is published in the Government Gazette and becomes final and has full evidentiary value in any administrative or judicial authority. The only possible way to change it is to appeal to the Council of State.
For this reason, the citizen whose property is affected by the designation of the Forest Map, is required to proceed with an objection.
Against the content of the posted forest map, objections may be submitted, within an exclusive period of sixty (60) days from on the day set by the relevant Forest Directorate of each Prefecture. For residents living abroad, the above deadline is extended by twenty (20) days . Objections are only submitted digitally on the relevant website of EKXA SA.
In order to submit a valid objection the following are needed:
- Signed copy of the objection, as generated using the online objection application,after receiving a protocol number.
- Evidence of the existence of a real or tortious right on the area under objection.
- Determine the geographical coordinates of the peaks of the area.
- Proof of submitting the special objection fee.
- Simple photocopy of ID or passport.
In case a third party files the objection, an authorization with the original signature is required.
In case a third party completes, signs and files the objection, a notarial power of attorney is required.
In addition to the mandatory data when submitting objections, any interested objector has the option to:
- Attach and accompany the objection with Photo Interpretation Technical Report for more effective documentation.
- To be represented by a technical advisor - Forester in the Objection Examination Committees.
The amount of the special fee is proportional to the area objected to, according to the following:
1) For an area of up to 100 sq.m. (par. 3 of article 2b of Law 2308/1995), five euros (€5.00).
2) For an area of up to 1,000 sq.m., (except point 1 above), twenty euros (€20.00).
3) For an area of more than 1,000 sq.m. up to 5,000 sq.m., forty-five euros (€45.00).
4) For an area of more than 5,000 sq.m. up to 10,000 sq.m., ninety euros (€90.00).
5) For an area of more than 10,000 sq.m. up to 20,000 sq.m., one hundred and seventy-five euros (€175.00).
6) For an area of more than 20,000 sq.m. up to 100,000 sq.m., three hundred and fifty euros (€350.00).
7) For an area of more than 100,000 sq.m. up to 300,000 sq.m., seven hundred euros (€700.00)
8) For an area of more than 300,000 square meters, one thousand six hundred and fifty euros (€1,650.00).
According to decision no. 146776/2459/21.10.2016 of the Deputy Minister of Environment and Energy (Government Gazette 3532B'), a manifest error is defined as any of the following:
- technical deviation or incorrect technical performance of the border lines observed on the photogrammetric backgrounds and results from either ground measurements or photointerpretive rendering of the thematic content of the map, which contradicts with the image, presented in them,
- omission, by mistake, of capturing a clearly forested area within another wider form (rural, etc.) and vice versa,
- clearly misrepresenting agricultural land as forest land and vice versa,
- misprinting of theme due to image (photo) shaped elements due to gradient areas,
- performance as a "grassland", area that concerns a flat and smooth sloping area, which is exempt from the provisions of the forestry legislation, according to the P.D. 32/2016 (Government Gazette 46 A'),
- performance as a "grassland", area that pertains to recognized, according to the written provisions , against the State as a private entity, which is exempt from the provisions of the forestry legislation,
- rendering as forest, an area that concerns an artificial forest plantation, which is exempt from the provisions of the forestry legislation and
- special errors due to failure to display actions of the administration before sanctioning the forest map.
